DMCA Policy

1. Introduction

dosya.dev ("we," "us," or "our") respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), Title 17, United States Code, Section 512, we will respond expeditiously to claims of copyright infringement committed using our service that are reported to our designated copyright agent.

If you are a copyright owner, or authorized to act on behalf of one, and you believe that your copyrighted work has been copied and is accessible on our service in a way that constitutes copyright infringement, please submit a notification pursuant to the DMCA by providing our designated copyright agent with the information outlined below.

2. Filing a DMCA Takedown Notice

To file a copyright infringement notification with us (a "DMCA Takedown Notice"), the complaining party ("Complainant") must provide a written communication that includes substantially the following information. Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability.

Your DMCA Takedown Notice must include the following:

  1. Identification of the copyrighted work: A description of the copyrighted work that you claim has been infringed. If multiple copyrighted works are covered by a single notification, provide a representative list of such works.
  2. Identification of the infringing material: A description of the material that you claim is infringing and that is to be removed or access to which is to be disabled, including the URL or other specific location on our service where the material can be found. Provide enough information to allow us to locate the material.
  3. Contact information: Your full legal name, mailing address, telephone number, and email address.
  4. Good faith statement: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. Accuracy statement: A statement that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  6. Signature: A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.

3. Designated Copyright Agent

You can file a DMCA Takedown Notice using our online form or by emailing our designated agent directly. Please note that any DMCA Takedown Notice sent to parties other than the designated agent may not be acted upon in a timely manner. Only DMCA-compliant notices will be processed.

4. How We Process Takedown Notices

Upon receipt of a valid DMCA Takedown Notice, we will:

  1. Remove or disable access to the allegedly infringing material promptly.
  2. Notify the user who uploaded the material (the "Respondent") that the content has been removed or disabled, and provide them with a copy of the DMCA Takedown Notice.
  3. Maintain records of all takedown notices received and actions taken.

We reserve the right to remove any content at our sole discretion, with or without a DMCA Takedown Notice, if we reasonably believe the content infringes any third-party intellectual property rights.

5. Filing a Counter-Notification

If you believe your content was removed or disabled by mistake or misidentification, you may file a written counter-notification ("Counter-Notice") with our designated copyright agent. Under the DMCA, if you file a Counter-Notice, we must provide the Complainant with a copy of the Counter-Notice and inform them that we will restore the removed content within 10 to 14 business days, unless the Complainant notifies us that they have filed a court action to restrain the infringing activity.

Your Counter-Notice must include the following:

  1. Identification: Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or disabled (including the URL).
  2. Good faith statement: A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.
  3. Consent to jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if your address is outside of the United States, any judicial district in which dosya.dev may be found), and that you will accept service of process from the Complainant or their agent.
  4. Contact information: Your full legal name, mailing address, telephone number, and email address.
  5. Signature: Your physical or electronic signature.

Counter-Notices should be sent to: dmca@dosya.dev with the subject line DMCA Counter-Notice.

6. Repeat Infringers

In accordance with the DMCA and other applicable laws, dosya.dev has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to our service and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

7. Misrepresentation

Please be aware that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability for damages, including costs and attorneys' fees.

If you are unsure whether the material you are reporting is in fact infringing, or whether the material that was removed was done so by mistake, you may wish to seek legal advice before filing a DMCA Takedown Notice or Counter-Notice.

8. User Responsibility

Users of dosya.dev are solely responsible for ensuring that all files uploaded, stored, shared, or transferred through our service do not violate the intellectual property rights of any third party. By using our service, you represent and warrant that you own or have the necessary licenses, rights, consents, and permissions to upload, store, and share all content through our platform.

dosya.dev does not pre-screen, monitor, or review the content uploaded by its users. We act as a neutral hosting provider and only take action upon receipt of a valid DMCA Takedown Notice or when we otherwise become aware of infringing content.

9. Modifications to This Policy

dosya.dev reserves the right to modify this DMCA Policy at any time. Changes will be effective immediately upon posting the updated policy on this page with a revised "Last updated" date. Your continued use of our service after any changes constitutes your acceptance of the modified policy.
